MPDialer LLC ("MPDialer," "Company," "we," "us," or "our") is committed to protecting the privacy of our users. This Privacy Policy describes how we collect, use, store, share, and protect personal information when you access or use the MPDialer platform, website, and related services (collectively, the "Service"). By using the Service, you consent to the data practices described in this Privacy Policy.
This Privacy Policy is incorporated into and made part of the MPDialer Terms of Service. Capitalized terms not defined herein have the meanings assigned to them in the Terms of Service.
1.1 Account Information. When you create an account, we collect your name, email address, phone number, state insurance license information, licensed states, and other registration details you provide.
1.2 Payment Information. When you subscribe to the Service or make a purchase, your payment information (credit card number, billing address) is collected and processed by our third-party payment processor. We do not store your full credit card number on our servers. We receive and store transaction confirmations, subscription status, and billing history.
1.3 Lead Data. The Service processes homeowner contact information including names, phone numbers, email addresses, mailing addresses, property addresses, mortgage information, and other publicly available property and demographic data. This data is obtained from public records and licensed third-party data providers.
1.4 Call Data. When you use the Service to place calls, we collect and store call metadata including call timestamps, call duration, call disposition, caller and recipient phone numbers, and call status information.
1.5 Call Recordings and Transcriptions. Calls placed through the Service are recorded and transcribed automatically for compliance monitoring, opt-out detection, quality assurance, and service improvement purposes. Call recordings and transcriptions are stored on our servers and with our third-party transcription service provider. You are solely responsible for providing any legally required notice or disclosure to the called party that the call is being recorded, and for obtaining any consent required under applicable federal and state call-recording laws. MPDialer's recording of calls is separate from, and does not satisfy, your independent obligation to disclose recording to, and obtain any required consent from, the parties you call (see Section 9 of the Terms of Service).
1.6 Usage Data. We automatically collect information about how you interact with the Service, including login times, session duration, features used, pages visited, dialing activity, and performance metrics.
1.7 Device and Browser Information. We may collect information about the device and browser you use to access the Service, including IP address, browser type, operating system, and device identifiers.
1.8 Communications. We collect and retain any communications you send to us, including support requests, feedback, and emails to info@mpdialer.com.
1.9 Third-Party Authentication. You may choose to sign in to the Service using your Google account via Google Sign-In (OAuth 2.0). When you use this feature, Google shares your email address and name with us solely for the purpose of creating or authenticating your account. We do not receive your Google password or any other Google account data. We do not use your Google account information for advertising or share it with third parties. Your use of Google Sign-In is also subject to Google's Privacy Policy at policies.google.com/privacy.
1.10 Phone Number Verification and SMS Messages. Account creation requires a verified phone number. When you register, we send a one-time verification code to your phone number via SMS to confirm ownership. Your phone number is also used for two-factor authentication each time you log in. SMS messages are delivered through our third-party telecommunications provider. By providing your phone number and checking the SMS consent box at registration, you consent to receive these transactional, account-security SMS messages from MPDialer. These messages are not marketing. Standard message and data rates may apply; message frequency varies. You may reply STOP to opt out or HELP for help (opting out may prevent SMS login; email authentication remains available). We do not sell or share mobile phone numbers or SMS opt-in data with third parties for their own marketing. Full details are in our SMS / Text Messaging Terms at app.mpdialer.com/sms-terms.
1.11 Email Messages. When you register, we send a one-time verification code to your email and use your email for login security codes, billing and subscription notices, password resets, and account and service notifications. By providing your email address and checking the email consent box at registration, you consent to receive these account-related and transactional emails from MPDialer. These emails are necessary to operate and secure your account; account-security and transactional emails cannot be opted out of while your account remains active.
2.1 We use the information we collect for the following purposes:
(a) To provide, operate, maintain, and improve the Service;
(b) To process your subscription payments and manage your account;
(c) To deliver lead data and dialing services;
(d) To record and transcribe calls for compliance monitoring and opt-out detection;
(e) To detect and flag do-not-call requests and opt-out language in call transcriptions;
(f) To provide customer support and respond to your inquiries;
(g) To send you service-related communications, including account notifications, billing confirmations, and technical notices;
(h) To monitor and enforce compliance with our Terms of Service and Acceptable Use Policy;
(i) To analyze usage patterns and improve platform performance and user experience;
(j) To verify your identity and secure your account through SMS verification codes and two-factor authentication;
(k) To protect against fraud, unauthorized access, and other security threats;
(k) To comply with legal obligations and respond to lawful requests from government authorities;
(l) To enforce our legal rights and defend against legal claims.
2.2 Anonymized and Aggregated Data. We may create anonymized, de-identified, or aggregated data from personal information by removing information that makes the data personally identifiable. We may use and share such anonymized data for any business purpose, including analytics, research, and platform improvement.
3.1 We do not sell your personal information to third parties. We share personal information only in the following circumstances:
(a) Third-Party Service Providers. We share information with third-party service providers who perform services on our behalf, including telecommunications infrastructure providers, cloud hosting providers, transcription and speech analysis providers, payment processors, email delivery services, and authentication providers (including Google LLC for Sign in with Google functionality). These providers are contractually obligated to use your information only to provide services to us and in accordance with this Privacy Policy.
(b) Legal Requirements. We may disclose your information if required to do so by law, regulation, legal process, or governmental request, including in response to a subpoena, court order, or regulatory inquiry.
(c) Protection of Rights. We may disclose information when we believe disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of our users or others.
(d) Business Transfers. In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of the transaction. We will notify you of any such transfer and any choices you may have regarding your information.
(e) With Your Consent. We may share your information with third parties when you have given us your explicit consent to do so.
3.2 We do not share your account information, call recordings, or transcriptions with other MPDialer users or agents.
4.1 Account Data. We retain your account information for as long as your account is active and for a commercially reasonable period following account termination to comply with legal obligations, resolve disputes, and enforce our agreements.
4.2 Call Recordings and Transcriptions. Call recordings and transcriptions are retained for a commercially reasonable period for compliance monitoring and operational purposes. Saved transcriptions are retained as long as your account is active. MPDialer may delete call recordings and transcriptions following account termination in accordance with its data retention schedule.
4.3 Lead Data. Lead data associated with your account is deleted from the dialing system upon account termination. Anonymized or aggregated data derived from lead data may be retained indefinitely.
4.4 Payment Records. Payment transaction records are retained as required by applicable tax and financial record-keeping laws.
5.1 We implement commercially reasonable technical and organizational security measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit, access controls, secure authentication, and regular security assessments.
5.2 While we take reasonable precautions to protect your information, no method of transmission over the Internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of your information. You acknowledge that you provide your information at your own risk.
5.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6.1 Account Information. You may update your account information at any time through your account settings or by contacting us at info@mpdialer.com.
6.2 Email Communications. You may opt out of promotional email communications by following the unsubscribe instructions in those emails. You cannot opt out of service-related communications (such as billing notifications and security alerts) while your account is active.
6.3 Data Deletion Requests. You have the right to request deletion of your personal data at any time. To submit a deletion request:

Include: Your full name and the email address associated with your account.
We will respond to all verified deletion requests within 30 days. Upon verified deletion, the following data will be permanently removed: your account profile, login credentials, and personal contact information associated with your account.
The following data may be retained after deletion where required by law or legitimate business necessity: call recordings and transcriptions (retained for TCPA compliance and legal protection), billing and payment transaction records (retained for 7 years per financial recordkeeping requirements), anonymized or aggregated usage statistics that cannot be linked back to you, and records required to comply with ongoing legal obligations or active disputes.
Data deletion is permanent and irreversible. We cannot recover deleted account data after the deletion is processed.
6.4 California Residents — CCPA/CPRA Rights. If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:
(a) Right to Know. You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which the information was collected, the business purposes for collecting the information, and the categories of third parties with whom we share the information.
(b) Right to Delete. You have the right to request that we delete personal information we have collected from you, subject to certain exceptions permitted by law.
(c) Right to Correct. You have the right to request that we correct inaccurate personal information we maintain about you.
(d) Right to Opt Out of Sale. We do not sell personal information. If this practice changes, we will update this Privacy Policy and provide you with the ability to opt out.
(e) Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA/CPRA rights.

7.1 The Service uses strictly necessary cookies only. These cookies are required for the Service to function and cannot be disabled without breaking core functionality. We do not use advertising cookies, analytics tracking cookies, or any third-party tracking technologies.
7.2 The following cookies are set by the Service:
"session" — Stores your encrypted authentication token so you remain logged in between page loads. This cookie is httpOnly (not accessible to JavaScript), transmitted only over HTTPS, and expires after 7 days.
"csrf" — Stores a security token used to protect form submissions from cross-site request forgery attacks. This is a functional security cookie required for all form interactions.
"totp_challenge" — Set temporarily (5 minutes) during two-factor authentication login to pass your identity between the login step and the verification step. Automatically expires.
7.3 Because all cookies set by the Service are strictly necessary for security and authentication, they are exempt from cookie consent requirements under GDPR, CCPA, and the ePrivacy Directive. No consent banner is required or displayed.
7.4 We do not use Google Analytics, Facebook Pixel, or any other third-party analytics or advertising cookies. Your browsing activity within the Service is not shared with advertisers.
The Service may contain links to third-party websites or services that are not owned or controlled by MPDialer. We are not responsible for the privacy practices of any third-party websites. We encourage you to review the privacy policies of any third-party websites you visit.
The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information promptly.
The Service is operated from the United States. If you are accessing the Service from outside the United States, you understand and consent to the transfer, storage, and processing of your information in the United States, where data protection laws may differ from those in your jurisdiction.
We may update this Privacy Policy from time to time to reflect changes in our data practices, legal requirements, or business operations. We will notify you of material changes by posting the updated Privacy Policy on our website and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the updated Privacy Policy.
